What’s up with KXL/ this EIS:

  • In response to a lawsuit filed by multiple organizations arguing permit was based on stale EIS, lawsuit was successful– concluded that a new EIS was necessary to move forward
  • The state department has been busy working on a supplementary EIS to move forward.
  • This hearing will be the basis for the last remaining permits to be issued or not issued
    • Army Corps section 408 (Missouri river crossing)
    • BLM
  • This is the ONLY hearing on KXL in the country before the permitting process
